Terms of Use

Welcome to Cohabital. These Terms of Use (“Terms”) form a legal agreement between you and Cohabital (“Cohabital,” “we,” “us,” or “our”) and govern your access to and use of cohabital.com and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements, that the information you provide is accurate, and that you will comply with these Terms and all applicable laws.

2. Your account

You are responsible for the information you provide and for all activity under your account. Keep your password confidential, use the Service as a single individual (one account per person), and notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms.

3. Verification badges are not guarantees

Email, phone, and identity (“ID Verified”) verification are optional tools intended to help build trust between members. Verification is not a guarantee of any member’s identity, character, background, creditworthiness, or intentions, and it is not a background check or tenant-screening service. Always use your own judgment and take normal precautions when interacting with other members.

4. Cohabital is a venue, not a party to your arrangements

Cohabital is a platform that helps members discover and connect with one another. We are not a party to any rental, lease, sublet, roommate, or other arrangement between members. We do not own, manage, inspect, endorse, or guarantee any room, property, listing, or member, and we are not a real-estate broker, landlord, property manager, or tenant-screening company in connection with member interactions. Any agreement you enter into with another member is solely between you and that member, and you are responsible for evaluating and deciding whether to proceed.

5. Safety

Your safety is important. We strongly recommend that you: communicate through the Service until you are comfortable; meet in a public place first and tell someone where you are going; view any room or property in person (or by live video) before committing; and trust your instincts. Do not rely solely on verification badges. Report suspicious behavior to us. We do not conduct background checks on members and are not responsible for the conduct of any member, online or offline.

6. Fees and payments

The Service is currently offered free of charge. We may introduce paid features, subscriptions, or other charges in the future. If we do, we will disclose the applicable pricing and terms before you incur any charge, and your use of a paid feature will be subject to those additional terms. If we later enable payments through the Service, additional terms (including terms of any third-party payment processor) will apply to those transactions.

Payments between members; scam awareness. Except for any fees you pay directly to Cohabital for our own paid features, payments and financial arrangements are between you and the other member. Whether or not the Service supports payments, use caution with money: never wire money, send gift cards, or pay a deposit or rent before you have seen the place in person and signed an appropriate agreement. Requests to pay before viewing, urgent pressure, or a host who “can’t meet in person” are common signs of a scam. You are responsible for any payments you choose to make.

7. Your content

You retain ownership of the content you submit, such as your profile, photos, listings, and messages (“Your Content”). You grant Cohabital a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute Your Content as needed to operate and promote the Service. You represent that you have the rights to Your Content and that it does not violate any law or the rights of others. We may remove content that we believe violates these Terms or is otherwise objectionable.

8. Prohibited conduct

You agree not to:

  • Provide false, misleading, or impersonating information, or create a fake or duplicate profile;
  • Harass, threaten, defame, stalk, or harm another person, or send spam or unsolicited advertising;
  • Post content that is unlawful, fraudulent, obscene, hateful, or infringing;
  • Use the Service for any commercial purpose we have not authorized, including brokering or advertising unrelated goods or services;
  • Collect or scrape information about members, or use bots or automated means to access the Service;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with the Service’s operation or security;
  • Violate any applicable law, including fair-housing, anti-discrimination, landlord-tenant, and consumer-protection laws.

9. Fair housing and non-discrimination

You are responsible for complying with all applicable fair-housing and anti-discrimination laws. Do not post listings or statements that express an unlawful preference, limitation, or discrimination. While roommate arrangements involving shared living space may be treated differently under some laws, you remain responsible for ensuring your conduct is lawful.

10. Listings

If you post a listing, you represent that it is accurate, that you have the right to offer the room or property, and that doing so complies with your lease, any applicable HOA or building rules, and local law. You are responsible for keeping your listing accurate and current, and for choosing whether to make it public or members-only.

11. Intellectual property

The Service and its content (excluding Your Content), including the Cohabital name, logo, and design, are owned by Cohabital or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

12. Third-party services

The Service may rely on or link to third-party services (for example, mapping, email, SMS, and verification). We are not responsible for third-party services, and your use of them may be subject to their own terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms or created risk for us or other members. Sections that by their nature should survive termination will survive.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ANY MATCH OR ARRANGEMENT WILL RESULT, OR THAT INFORMATION PROVIDED BY MEMBERS IS ACCURATE OR RELIABLE. YOU USE THE SERVICE AND INTERACT WITH OTHER MEMBERS AT YOUR OWN RISK.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COHABITAL AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify and hold harmless Cohabital and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, Your Content, your interactions with other members, or your violation of these Terms or the law.

17. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 18.

18. Dispute resolution; binding arbitration; class-action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal resolution first. Before starting an arbitration or other proceeding, you agree to first try to resolve the dispute informally by contacting us at support@cohabital.com and giving us at least 30 days to resolve it.

Binding individual arbitration. If we cannot resolve a dispute informally, you and Cohabital agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by a recognized arbitration provider under its then-current rules, rather than in court — except as provided below. The arbitration will take place in King County, Washington, or another mutually agreed location (or by video/phone where available), and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Cohabital agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to stop actual or threatened infringement or misuse of intellectual property or unauthorized access to the Service.

Your right to opt out. You may opt out of this arbitration agreement and class-action waiver within 30 days after you first accept these Terms by emailing legal@cohabital.com with your name and a clear statement that you opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in King County, Washington, and you and Cohabital consent to the exclusive jurisdiction and venue of those courts.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
